HUNTING RELEASE AND INDEMNIFICATION
The undersigned, in return for access to & use of Ankeny Ranch/42401 WCR 66, Briggsdale, CO or other property (hereinafter "the property") as a licensee, invitee, guest, or sub-lessee of Walt Rosenberg, acknowledges he/she is well aware of the hazards on said property and assumes all risks of personal injury or property damage, and agrees to indemnify and hold harmless Walt Rosenberg/Ankeny Ranch and its partners, employees, guides or agents (hereinafter "the Released Party") from any claim, demand, action or cause of action arising from or related to the property and/or hunting thereon.
The undersigned further releases the Released Party from and agrees to indemnify and hold the Released Party harmless from any and all claims, demands, liabilities, losses, causes of action and expenses (including court costs and reasonable attorney fees arising from:
(1) The undersigned’s use of the property or any part thereof; (2) The undersigned’s hunting activity on the property as well as the hunting activity of any other person on the property; (3) Any act, omission, negligence of the Released Party or any agent, officer, employee, guests, customer, subtenant, assignee or invitee of Walt Rosenberg/Ankeny Ranch; including any act, omission, or negligence resulting in injury or death.
The undersigned certifies that he/she is proficient in handling firearms safely and that he/she will comply with all hunter safety practices recommended or required by the State of Colorado and/ or Colorado Department of Wildlife.
Venue shall be proper only in Weld County, Colorado for any action brought by the undersigned in any way relating to the hunt(s), the property, and / or this agreement.
